Provisional Wavier Process

U.S. Citizenship and Immigration Services (USCIS) has announced a ruling which allows for specific individuals who are family members of U.S. citizens and lawful permanent residents (LPRs), and who are eligable for immigrant visas, to more easily navigate the immigration process. The provisional wavier process is the next step that allows for families to stay together even though some family members may not be in the United States as a citizen.

Until now the only people who would be able to benefit from these rights were immediate family members such as spouses and children. This rule was introduced in 2013, but the regulation expands the eligibility for the process to all individuals who are statutorily eligible for the wavier.

This new regulation made changes to the I-601A form, the Application for Provisional Unlawful Presence Wavier. These changes will take place along with the final hearing on August 29, 2016.
